1. Acceptance of Terms
By accessing or using PlayPath ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of a school, district, or other organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
PlayPath is an educational game platform designed for K-12 students. The Service provides adaptive learning challenges, skill mastery tracking, and teacher analytics tools. PlayPath can be accessed directly through the web or through a school's learning management system (LMS) via LTI integration.
3. User Accounts
The Service supports the following account types:
- Teacher accounts: Created by educators to manage classrooms, assign content, and view student progress analytics.
- Parent accounts:Created by parents or guardians to monitor their child's learning progress, manage consent, and exercise data rights.
- Student accounts: Created through school LMS integration (LTI) or by a parent. Students under 13 cannot create accounts independently.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to collect, harvest, or store personal data about other users without their consent.
- Share, redistribute, or commercially exploit any content from the Service without written permission.
- Use automated tools, bots, or scrapers to access the Service without prior authorization.
5. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, educational content, challenge designs, and software, are the exclusive property of PlayPath or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Teachers and schools retain ownership of any original content they create and upload to the Service. By uploading content, you grant PlayPath a non-exclusive, royalty-free license to use, display, and distribute that content solely for the purpose of providing the Service.
6. Data Privacy
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
We comply with the Children's Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), and the General Data Protection Regulation (GDPR) as applicable.
7. Disclaimers and Limitations of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
PlayPath does not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any learning outcomes or academic performance resulting from use of the Service.
To the maximum extent permitted by applicable law, PlayPath shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
8. Age Requirements
Users under the age of 13 may only use the Service with verifiable parental consent or through a school-authorized LTI integration where the school provides consent under FERPA. Users between the ages of 13 and 18 may use the Service with parental awareness. Users must be at least 18 years old to create a teacher or parent account.
9. School and Institution Agreements
Schools and educational institutions may enter into separate agreements with PlayPath that govern the use of the Service within their organization. In the event of a conflict between these Terms and a school agreement, the school agreement shall prevail with respect to the school's use of the Service.
Schools using the Service through LTI integration agree to act as the FERPA-authorized agent for their students and to obtain any necessary parental consent for the use of the Service.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by posting the updated Terms on the Service and updating the "Last updated" date. For school accounts, we will provide at least 30 days' notice before material changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request export of your data before or after termination by contacting us.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which PlayPath is incorporated, without regard to conflict of law principles.
